Terms of Service - PandaPanda Kids

Welcome to PandaPanda Kids. These Terms of Service ("Terms") govern your use of the PandaPanda Kids application and related services. By creating an account or using the app you agree to these Terms. If you do not agree, please do not use the app.

1. Eligibility

You must be at least 18 years old to create a PandaPanda Kids account. The app is designed for children under 13 to use under parental supervision through child profiles created by the parent or legal guardian account holder. By creating an account you represent that you are 18 years of age or older and that you have legal authority to consent on behalf of any child profiles you create.

2. Subscription and Payment

PandaPanda Kids is offered as an auto-renewing subscription through Apple's App Store. Available plans and current pricing are displayed on the Subscription screen within the app. As of the Effective Date, the available plan is $4.49 per month.

Billing: Payment is charged to your Apple ID at confirmation of purchase.
Auto-renewal: Subscriptions automatically renew at the same price unless canceled at least 24 hours before the end of the current billing period.
Cancellation: You may cancel anytime in iPhone Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period.
Refunds: Refunds are governed by Apple's refund policy. Contact reportaproblem.apple.com to request a refund.
Free trial (if offered): Any unused portion of a free trial period is forfeited when you purchase a subscription.

3. Acceptable Use

You agree not to:

Reverse engineer, decompile, or attempt to extract the source code of the app.
Use the app for any unlawful purpose or in violation of any applicable law.
Share, redistribute, or commercially exploit the music, audio files, or other content provided through the app.
Use any automated means to access the app, scrape content, or interfere with the service.
Misrepresent your age or your authority to consent on behalf of a child.

4. Intellectual Property

All content in the app including music, audio recordings, artwork, characters, and the PandaPanda Kids name and logo is owned by PandaPanda Kids or licensed for use within the app. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes for the duration of your active subscription.

5. Children's Content

We make commercially reasonable efforts to curate content that is appropriate for children. By design the app contains no advertising, no external links accessible to children, no social features, and no user-generated content.

6. Apple's Standard EULA

To the extent any provision of Apple's standard End User License Agreement conflicts with these Terms, Apple's standard EULA applies as a minimum baseline for the licensed application. You can review Apple's standard EULA at apple.com/legal/internet-services/itunes/dev/stdeula.

7. Disclaimers and Limitation of Liability

The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the app is limited to the amount you paid for the subscription in the 12 months preceding the claim.

8. Termination

You may stop using the app at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the app ends immediately. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitation of liability.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app and by email. Continued use of the app after a change becomes effective constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law principles. Any dispute will be resolved in the state or federal courts located in Doña Ana County, New Mexico, and you consent to the exclusive jurisdiction of those courts.
